"At the start of an ICC arbitration, the Court fixes the amount of the advance on costs in a sum likely to cover the costs of the arbitration. Leaving aside the administrative costs, the travel and other expenses of the arbitrators, and the costs of a possible expertise, very much the greatest part of the costs of the arbitration consists of the fees of the arbitrators. The fees of the arbitrators are primarily set on the basis of the scale attached to the Rules of Arbitration. This scale is applied on the basis of the sum in dispute. Taking into account that, according to Article 6 of the Rules, the Secretariate receives a copy of all written statements filed by the parties, the Secretariate must exercise diligence and approach the parties as soon as the amount in dispute increases. There would certainly be no excuse if the Secretariate failed to take proper action in this respect.
