This is necessary because India is not party to the Treaty on the Non- Proliferation of Nuclear Weapons (‘NPT’). The Act provides that if certain conditions are in place, the decision to grant authorisations for nuclear material and nuclear related items to be exported to India will not be taken to be inconsistent with Australia’s obligations under the NPT and the South Pacific Nuclear Free Zone Treaty. The first condition is that the Agreement between the Government of Australia and the Government of India on Cooperation in the Peaceful Uses of Nuclear Energy must be in force.
