To point out that appearance also will be a factor in jury considerations is to state the obvious. This commonsense observation has been given substance by studies on juries and juror behavior. The pioneer effort in jury research, The American Jury, 1 pointed to the accused's physical appearance as being one factor that has an influence on jurors in their deliberations. Subsequent studies have focused with greater par- ticularity on the effects of physical appearance on judgments of guilt and innocence. 2 This line of research has led to development of the theory that stereotypes in- fluencing a juror's evaluation of a case will be formed by a juror from the observation of the defendant's physical characteristics. 8 While more conclusive proof of this theory is needed, the probability that stereotyping is a factor that affects juries remains and is something with which lawyers should be concerned.
